Supreme Court Case Could Impact Control of Congress in 2024 Elections

The case involves the redrawing of congressional voting boundaries by the Republican-controlled legislature in South Carolina, with questions raised about whether race was used as a proxy for partisan affiliation, potentially violating the 14th Amendment. The outcome of this case could depend on the votes of the three newest conservative justices: Neil Gorsuch, Amy Coney Barrett, and Brett Kavanaugh.

During oral arguments at the Supreme Court, Justice Elena Kagan pointed out disparities in the treatment of Black Democrats and White Democrats, suggesting that Black Democrats were being excluded from the district at a higher rate. However, Chief Justice John Roberts expressed concerns about accepting the arguments of the plaintiffs challenging the state’s redistricting efforts. The court’s conservative majority also expressed concern over a federal court ruling that ordered the state to create a new congressional map before the November 2024 election.

The case specifically focuses on the 1st Congressional District in South Carolina, currently represented by Rep. Nancy Mace (R). A three-judge panel found that the redistricting efforts resulted in an unlawful racial gerrymander, shifting Black voters from Charleston County to the 6th Congressional District, which became more solidly Democratic. The state argues that partisan politics and population growth along coastal areas were the driving factors behind the redistricting, denying any racial motive.

Groups like the NAACP and ACLU have challenged the boundaries, claiming that the Republican-led legislature intentionally adopted a map that disadvantaged Black voters. Both sides have requested an expedited ruling by January 1 to allow for the possibility of new maps being redrawn. The outcome of this case could have broader implications for the 2024 elections and ongoing redistricting efforts in other states.

This Supreme Court ruling could potentially affect the balance of power in the House of Representatives, as Democratic pickups in South Carolina, Alabama, and Louisiana could tip the scales in favor of the Democrats. The justices are aware of the nationwide implications of their decision, with Justice Samuel Alito defending the Republican-drawn map and questioning the conclusions of opposing experts. Justice Ketanji Brown Jackson, on the other hand, echoed the arguments of those challenging the map.

A ruling on the case, Alexander v. South Carolina State Conference of the NAACP, is expected by January 2024, just a month before the South Carolina primary on February 24. The decision will be closely watched as it could have far-reaching consequences for voting rights and the upcoming elections.
