Alleged Rape Case Unravels: Medical Evidence vs. Consensual Video Footage

A Texas woman accused of fabricating rape claims against a police officer and his friend maintains her allegations are true, claiming to possess ample medical evidence in support.

Amanda Zawieruszynski, 40, asserts that she had to undergo surgery to repair internal and external damage caused by the alleged November assault, which she says was perpetrated by El Campo Police officer Freddie Douglas and his friend John Marks.

Her attorney, Thomas Cammack, told The Post, “Despite recent claims and circulation of a misleading and harmful narrative, it is clear that Ms. Zawieruszynski was raped and did not consent to any sexual activity with the perpetrators.

Zawieruszynski had been casually dating 41-year-old Marks – her neighbor on their Manvel street, just outside of Houston – when she stopped over at his place for a late-night swim on Nov. 11. She claimed that on that night Marks invited 43-year-old Douglas along, and the two men allegedly forced themselves on her violently.

Both men were arrested and Douglas was fired from the police department, but later the charges were dropped by a grand jury after they produced footage from the house, which showed that the three did have sex; however, it was entirely consensual, according to a lawsuit filed by Douglas. He sued both Zawieruszynski and the Manvel Police Department for damages, alleging his life had been turned upside down by the allegations and accusing the police of arresting him without examining the video evidence he claimed he possessed.

He was named “officer of the year” and is a father of two. He said he had to sell his home to cover legal fees and needed help from his mother to come up with $100,000 for bail. Douglas even presented footage from Marks’ home-security system that showed Manvel police officers discussing the video evidence that would later exonerate him as they searched the house initially.

Despite these claims and developments, Zawieruszynski is not backing down on her allegations. After the incident, Ms. Zawieruszynski sought immediate medical attention where a thorough forensic examination was conducted, which provided substantial evidence supporting the fact that the encounter was non-consensual and that the victim’s injuries were consistent with sexual assault,” Cammack said.

Zawieruszynski has filed her own lawsuit against Douglas and Marks, alleging “sexual assault, assault, battery, false imprisonment, and intentional infliction of emotional distress.” Douglas, meanwhile, stands by his evidence.

Ms. Zawieruszynski has fled her home in Texas and is avoiding service of our lawsuit. We are aware of her alleged ‘rape kit.’ Presumably, the Grand Jury that no-billed this case was also made aware of the rape kit,” said Michael Kerenksy, Douglas’ attorney, adding that they remain convinced that the video evidence will again exonerate his client.

The Manvel Police Department told The Post they were the target of “false or misleading allegations” and stated they “work to uphold the highest standards of the law enforcement profession,” adding that “the outcomes of this legal action will demonstrate that we have upheld these standards.
