Judge Orders Fani Willis to Step Aside or Fire Special Prosecutor in Trump Case Amid Allegations of Improper Affair

Fulton County special prosecutor Nathan Wade has resigned from the Georgia election interference case against former President Donald Trump and 18 co-defendants. This comes after a ruling by Fulton County Superior Court Judge Scott McAfee, stating that either Wade must leave the case or District Attorney Fani Willis would be disqualified from prosecuting Trump. Four co-defendants had accused Willis of having an “improper” affair with Wade, whom she hired to help prosecute the case.

In a letter to Willis, Wade offered his resignation “in the interest of democracy” and to move the case forward as quickly as possible. Willis accepted his resignation and commended him for his professionalism and dignity throughout the process. However, former President Trump took to his Truth Social platform to criticize Wade, calling his resignation a “disgrace.”

The defendants alleged that Willis and Wade had a pre-existing romantic relationship and went on several trips together, with Wade’s law firm billing taxpayers $650,000 for their services. Michael Roman, a Republican operative who worked on Trump’s 2020 re-election campaign, claimed that the income from these trips was used to pay for vacations with Willis.

Both Wade and Willis denied being in a romantic relationship prior to his hiring, with Willis stating that the allegations were made against her because she is Black. During a two-day evidentiary hearing, witnesses testified that Wade and Willis were romantically involved, including a former friend of Willis who claimed to have observed them showing affection.

In a surprising move, Willis took the stand in her own defense and contradicted the testimony of her former friend. One expert described Willis’ testimony as “belligerent,” and she raised eyebrows for appearing to wear her dress backwards.

Despite the allegations, Judge McAfee determined that the defendants failed to prove that Willis had an actual conflict of interest in the case. However, he acknowledged the appearance of impropriety and ordered either Wade or Willis to step aside from the case.

McAfee is presiding over the prosecution of Trump and more than a dozen other defendants charged in an alleged illegal attempt to overturn the 2020 presidential election in Georgia. Willis’ indictment charges Trump and others with violating Georgia’s Racketeer Influenced and Corrupt Organizations Act. Trump has denied any wrongdoing and pleaded not guilty.

In a separate ruling, McAfee quashed six counts in the Georgia election interference case against Trump and his co-defendants, citing a lack of sufficient detail. Despite Wade’s resignation, he expressed confidence that the case against Trump “will be in good hands moving forward.”
