Legal Grounds for Removing Trump from 2024 Ballots Debated by GOP Strategist and Former State Department Official

In a recent legal development, a federal judge dismissed most of the civil counts against former President Donald Trump and two others in connection with the death of Capitol Police Officer Brian Sicknick during the U.S. Capitol riots on January 6. The ruling has sparked a debate among Republicans and legal experts regarding the grounds for removing Trump from 2024 ballots.

The lawsuit, filed by Sandra Garza, Sicknick’s girlfriend, sought damages from Trump and two rioters, Julian Khater and George Tanios, for claims of wrongful death, conspiracy to violate civil rights, and negligence per se based on D.C.’s anti-riot law. U.S. District Judge Amit Mehta dismissed three of the five civil counts, including the wrongful death act count and both negligence per se allegations. However, the claims under D.C.’s Survival Act and the conspiracy to violate civil rights will proceed.

The Survival Act allows legal action to be pursued on behalf of an individual after their death. Garza’s attorney, Mark Zaid, has not yet responded to requests for comment on the ruling. The dismissal of certain counts against Trump has raised questions about the legal implications for his potential candidacy in the 2024 presidential election.

Capitol Police Officer Brian Sicknick, who tragically lost his life during the riot, has been hailed as a hero for his efforts to protect the Capitol. The 42-year-old officer, who joined the Capitol Police in 2008, was pepper-sprayed by Khater and Tanios while responding to the chaotic scene. He was rushed to the hospital but succumbed to two thromboembolic strokes the following evening.

The ruling by the D.C. medical examiner’s office determined that Sicknick’s cause of death was “natural” and attributed it to a series of strokes. However, it also acknowledged that the events of January 6 played a role in his condition. This finding adds another layer of complexity to the ongoing legal challenges faced by Trump in relation to his alleged role in the Capitol riot.

Trump, who is known for his combative approach to legal battles, has faced numerous legal challenges since leaving office. Last month, a federal appeals court rejected his attempts to dismiss civil claims seeking accountability for the riot, citing the absence of presidential immunity.

The dismissal of certain civil counts against Trump, coupled with the Survival Act claims and the conspiracy to violate civil rights proceeding, has significant implications for his political future.
