Controversy Surrounds Colorado Supreme Court’s Decision to Remove Trump from 2024 Ballot

In a recent op-ed, political contributor Karl Rove discusses the legal basis of Colorado’s efforts to remove former President Donald Trump from the 2024 ballot. The move has sparked a heated debate, with a growing number of political commentators and experts calling for President Joe Biden to denounce the Colorado Supreme Court’s decision.

Former White House press secretary Ari Fleischer took to X to suggest that Biden should publicly criticize the ruling, stating that it would be a strong political move for him. Fleischer argued that Biden should demonstrate confidence in his ability to win the election without resorting to tactics such as removing Trump from the ballot. However, Fleischer believes that Biden is too afraid of the progressive left and lacks the strength to stand up to them.

Echoing this sentiment, host Laura Ingraham posted on X that the smartest move for Biden would be to direct the Department of Justice (DOJ) to oppose Colorado’s efforts. According to Ingraham, Democrats in Colorado are removing Trump from the ballot because they oppose democracy. Ingraham suggests that if Biden and the media truly believed in democracy, they would denounce this action immediately.

Jonathan Turley, a Shapiro professor of public interest law at George Washington University and a Digital contributor, argues that this is an opportunity for Biden to convey the image he cultivated during the election. Turley quotes James Freeman Clarke, saying “a politician thinks of the next election; a statesman thinks of the next generation.” Turley believes it is time for Biden to show that he can think of the next generation and oppose this ruling.

Alex Conant, founding partner at Firehouse Strategies, advises Biden to distance himself from the efforts to remove Trump from the ballot. Conant suggests that the more partisan it appears, the more it will benefit Trump.

David Avella, chairman of GOPAC, states that the issue goes beyond President Biden and calls for a 9-0 ruling from the U.S. Supreme Court to send a definitive signal that the Colorado court’s action is unconstitutional.

So far, President Biden has declined to denounce the Colorado court ruling and has refrained from providing a comment when asked by a reporter. Biden has instead deferred to the court’s decision, emphasizing the need for the court to determine whether the 14th Amendment applies.

The Colorado Supreme Court’s ruling, citing the 14th Amendment and the Capitol riot of January 6, 2021, disqualifies Trump from appearing on the state’s ballots in 2024. While the ruling is stayed until January 4 due to likely appeals, it is widely expected that Trump will take the case to the Supreme Court.
