Federal Judge Denies Trump’s Claim of Presidential Immunity in Jan. 6 Case

In a significant development, a federal judge in Washington, D.C. has rejected former President Donald Trump’s claim of presidential immunity and ruled against his request to dismiss the Jan. 6 case. U.S. District Judge Tanya Chutkan of the District of Columbia denied Trump’s argument that the Constitution grants him “absolute immunity from criminal prosecution for actions performed within the ‘outer perimeter’ of his official responsibility.” The judge stated that former presidents do not enjoy any special conditions on their federal criminal liability.

In her opinion, Judge Chutkan emphasized that Trump could be subject to federal investigation, indictment, prosecution, conviction, and punishment for any criminal acts undertaken while in office. She also dismissed Trump’s First Amendment argument, stating that the Constitution does not protect speech that is used “as an instrument of a crime.”

The charges against Trump include conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding, and conspiracy against rights. This ruling comes after a federal appeals court earlier in the day determined that Trump is not immune from civil lawsuits related to the events of Jan. 6, 2021.

Following the court’s decision, Steven Cheung, a spokesperson for the Trump Campaign, criticized the ruling and accused “Radical Democrats” and President Joe Biden of attempting to interfere with the 2024 Presidential Election. Cheung vowed that Trump will continue fighting for America and Americans by challenging these decisions in higher courts.

The Chief Judge of the United States Court of Appeals for the District of Columbia Circuit, Sri Srinivasan, also affirmed that Trump is not entitled to immunity. This ruling has significant implications for the former president’s legal battles and potential accountability for his actions leading up to and on Jan. 6.
