In a recent announcement, Vice President Kamala Harris revealed plans for a Biden administration effort aimed at tackling gun violence by providing training and technical assistance to individuals responsible for implementing laws designed to keep guns away from potential threats. However, the initiative, known as the National Extreme Risk Protection Order (ERPO) Resource Center, has drawn immediate backlash from Republicans, who criticize it as a “massive Red Flag Operation.”

The ERPO Resource Center, as outlined in a Department of Justice press release, will offer assistance to various stakeholders, including law enforcement officials, prosecutors, attorneys, judges, clinicians, victim service and social service providers, community organizations, and behavioral health professionals. The program intends to establish a civil process, similar to domestic violence protection orders, allowing concerned parties to petition a court to temporarily prohibit individuals at risk of harming themselves or others from purchasing or possessing firearms.

Ryan Petty, the father of a student who tragically lost their life in the Parkland high school shooting in 2018, expressed his displeasure with Vice President Harris’ visit to the grounds of Marjory Stoneman Douglas High School. Petty criticized the visit as a mere “photo op” to push an agenda, describing it as a “slap in the face.”

During her visit, Vice President Harris is expected to introduce the ERPO initiative and call on states to pass red flag laws while urging them to utilize federal funding to implement existing laws. Attorney General Merrick Garland highlighted the importance of the effort, emphasizing that the center will provide valuable resources to keep firearms away from individuals deemed a threat to themselves or others.

The ERPO Resource Center’s website will serve as a platform for stakeholders to access critical information, share emerging and promising practices, and connect with innovative strategies to reduce gun violence and save lives. The Department of Justice, in partnership with the Bureau of Justice Assistance, will maintain and update the website to include newly developed resources for effective ERPO implementation.

Criticism of the ERPO Resource Center quickly emerged from House Republicans, accusing the Department of Justice of violating Americans’ Second Amendment rights. Kentucky GOP Representative Thomas Massie expressed his concern over the establishment of a “Federal Red Flag center” without proper authorization, coincidentally announced just hours after the omnibus bill was passed.

Georgia Republican Representative Marjorie Taylor Greene raised similar concerns, questioning how the initiative could potentially target specific individuals. Greene’s comments came after she filed a motion to vacate the omnibus bill, accusing House Speaker Nancy Pelosi of betraying the confidence of the House GOP Conference.

The Biden administration has been vocal about its commitment to implementing various gun control measures. During his recent State of the Union address, President Biden called for a ban on assault weapons and high-capacity magazines, while also emphasizing the need for universal background checks. Republicans, however, argue that these measures infringe upon Second Amendment rights and unfairly vilify responsible gun owners.

As of now, the Department of Justice has not responded to requests for comment regarding the ERPO initiative. The controversy surrounding the National Extreme Risk Protection Order Resource Center highlights the ongoing debate between Republicans and Democrats over gun control policies in the United States.
