Georgia Judge Allows Embattled DA Fani Willis to Stay on Trump Case Despite ‘Sordid Scandal’ and ‘Lapse in Judgment

Republican Georgia State Sen. Bill Cowsert appeared on Fox & Friends to discuss the ongoing investigation into Fulton County District Attorney Fani Willis. This comes after special prosecutor Nathan Wade stepped down from the case against former President Trump. In a recent development, Fulton County Superior Judge Scott McAfee announced that Trump and his co-defendants have the opportunity to appeal the order denying the disqualification of DA Fani Willis.

Judge McAfee issued a certificate of immediate review, granting Trump and his co-defendants 10 days to submit an application to the Georgia Court of Appeals. The Court of Appeals will then have 45 days to decide whether they will hear the case. It is important to note that the Georgia Court of Appeals is not obligated to hear the case under Georgia law.

Steve Sadow, lead counsel for the former president, expressed optimism regarding the judge’s decision, stating that the defense is hopeful that appellate review will lead to the dismissal of the case and the disqualification of the DA.

While the defense focuses on having Willis disqualified, Judge McAfee will continue to address other pre-trial motions in the case. The allegations against Willis include an improper affair with Nathan Wade, whom she hired as special counsel for the case. Trump and his co-defendants claim that Willis had a romantic relationship with Wade prior to his hiring and that she financially benefited from his position in her office. Both Willis and Wade have denied these allegations.

After hearing all the evidence presented, Judge McAfee gave Willis an ultimatum: either remove herself from the case or fire Wade. Following the judge’s order, Wade resigned from the case. McAfee stated that the defendants failed to prove that the District Attorney had an actual conflict of interest through her personal relationship with Wade.

However, McAfee acknowledged a significant appearance of impropriety that tainted the prosecution team. He offered two options to address this appearance of impropriety – Willis and her entire office can step aside or Wade can withdraw from the case. While he denied the defendants’ claims of an actual conflict, he emphasized that his finding does not condone the District Attorney’s lapse in judgment or unprofessional behavior during the evidentiary hearing.
